Organisers
Skoda Auto Volkswagen India Private Limited ("Volkswagen India") has authorised
Project GTO Publishing LLP ("GTO") to undertake and organise the Volkswagen
Experiences, GT Track Day ("Event"), and the related activities. In these terms
and conditions, GTO along with its shareholders, sponsors, affiliates,
sub-contractors and suppliers and all of their respective officers, directors,
employees and agents are collectively referred to as the "Organisers".
GTO is the party that registers Guests, collects any registration fee payable
(through GTO's designated payment gateway), issues the receipt for such payment,
and is responsible for processing refunds and payment disputes/chargebacks arising
from the Event. Volkswagen India is not a party to, and bears no responsibility
for, the payment transaction between the Guest and GTO. Volkswagen India's role
in relation to the Event includes authorising and supporting the Event and making
the Provided Vehicles (defined below) available; CoASTT race track is an independent
venue operator engaged by GTO to host the Event, and instructors and other service
providers are engaged by GTO as described under Third Parties below.
Guest
The terms and conditions below govern the relationship between you, the participant
in the Event, referred to as "Guest", and the Organisers. By registering for the
Event and making payment of the agreed amount (where applicable) to the Organisers,
you agree to be bound by these Terms and Conditions.
Third Parties
Although GTO is making the arrangements for the Event, its responsibility is limited.
GTO is involved in the bookings related to the Event but does not act as an agent for
any party whatsoever. The limits of its responsibility arise from the fact that it
liaises with the race track and/or suppliers and instructors to supply goods and
services to Guests; however, such third parties are not GTO's employees, agents,
employers or principals.
Accordingly, each Guest agrees that GTO shall not be deemed to manage, control or
supervise the goods or services they supply and shall not be liable for any acts or
omissions on the part of such third parties or any other defect in such goods or
services, save that nothing in these Terms and Conditions excludes liability for a
third party's proven gross negligence or wilful misconduct.
By accepting and utilising the goods and/or services of such third parties, each
Guest agrees that GTO shall not be held liable in any way for any injury, loss,
damage, delay, death or property loss or damage arising from any act or omission
of any such third party. Guests will be subject to the terms and conditions, if any,
made applicable by such third-party suppliers.
The Organisers have made best efforts to procure the best facilities for the Event,
keeping the comfort and convenience of the Guests as a priority. While the Organisers
will make efforts to ensure the delivery of services to be provided by third parties,
the Organisers act only as a facilitator for the Guest and Volkswagen India, and shall
under no circumstance accept responsibility for inadequate, deficient or negligent
services provided by third parties. Any grievance or complaint regarding third-party
services shall be lodged directly with the concerned third party.
The Guest shall be liable to make good any damage caused by any wilful or negligent
act of the Guest to the property of the Organisers and third parties. The extent and
amount of any such damage will be as determined by the concerned third party, and the
Organisers shall not intervene in this determination.
Itinerary
The Organisers take all reasonable steps at the time of finalising the itinerary for
the Event to ensure that it suits the convenience and comfort of the Guests. However,
the Organisers reserve the right to change the itinerary for any reason they deem fit,
without being bound to seek prior permission or give prior notice to any Guest.
Where the itinerary changes, the Organisers will inform Guests at the earliest
possible time.
The Organisers will not be responsible for expenses incurred by Guests in preparation
for the Event or for any other travel arrangements made by them.
The Organisers may cancel the Event if the minimum number of participants stipulated
beforehand is not reached. In such an event, the Organisers will inform Guests at the
earliest possible time, and at least one week before the Event, and any payments made
towards the Event will be refunded in full.
The Organisers shall not be responsible for any delays or alterations to the itinerary,
or expenses incurred directly or indirectly, due to natural hazards, accidents,
mechanical breakdowns, weather, sickness, political closures, prohibition orders,
local unrest, traffic jams, medical emergencies or any other untoward incidents.
Guests must strictly adhere to the prescribed timetable for the Event so that it can
be completed within the defined schedule. Where any activity is missed due to a delay
caused by the Guest or for any other reason, no refund will be due for the same under
any circumstances.
Where the Event proceeds in a shortened, modified or otherwise curtailed form because
of weather or any other circumstance beyond the Organisers' reasonable control
(force majeure), this is treated as force majeure and does not entitle the Guest to
any refund, credit or other compensation, whether the curtailment affects part or all
of the remaining Event.
Refund Policy
- 50% refund if cancelled 20 days or more before the Event.
- 0% refund if cancelled within 20 days of the Event.
Please note that processing times for refunds may vary depending on your payment provider.
Cancellation Policy
The Organisers, in their sole discretion, reserve the right to terminate the Event
entirely and/or to modify, change, alter and/or delete any and all terms, conditions
and rules regarding: (1) the Event in general; (2) Guest participation in the Event;
and (3) the nature, level, value, frequency and amount of any individual prizes and
awards to be given to any Event participants, at any time before and/or during the
Event, without notice.
The Organisers will provide a confirmation e-mail at the time of registration, which
serves as notification that you are scheduled for the Event. Any further correspondence
relating to safety protocols is a courtesy and does not serve as an additional
confirmation or reminder.
Cancellation notices received 20 days or more prior to the Event will receive a
50% refund. There are no refunds for cancellations received within 20 days of the Event.
Rescheduling and Material Changes
If the Organisers materially change the date or venue of the Event, the Organisers
will notify Guests as soon as reasonably possible. A Guest who does not wish to attend
the Event on the revised date or at the revised venue may decline to attend by
notifying the Organisers, and before the revised Event takes place.
Where a Guest declines in these circumstances, the registration fee paid will be
refunded in full, notwithstanding the Refund Policy above.
Vehicles Used in the Event
Guest's Own Vehicle
For the Lead & Follow laps and the Timed Autocross competition, Guests will drive
their own vehicle ("Guest's Vehicle"). By registering for the Event, the Guest confirms
and agrees that:

The Guest holds a full and valid driving licence recognised in India, with at
least one year's driving experience, and shall carry the original licence at the
Event and produce it before driving commences. Failure to produce the original
licence will disqualify the Guest from driving, without exception.

The Guest's Vehicle is roadworthy and fitted with tyres in good condition, and
the Guest holds valid registration and insurance for the vehicle, and shall
produce these documents if requested by the Organisers.

The Guest's Vehicle, including any modified or tuned vehicle, will be subject to
a scrutineering/safety check by the Organisers before it is permitted on track,
covering (without limitation) tyres, brakes, fluid leaks, structural condition,
seating and restraint systems, and any modification affecting safety. The Event's
chief instructor/scrutineer has absolute discretion to refuse entry to any vehicle
deemed unsafe or unsuitable for the Event, whether or not modified, without any
obligation to refund fees paid.

Guests bringing their own vehicle will be sent a pre-event Vehicle Checklist
(covering items such as tyres, brakes, fluid leaks, loose equipment, and
registration/insurance documentation) ahead of the Event, and are responsible
for ensuring their vehicle meets this checklist before arriving.

The Guest shall drive the Guest's Vehicle only in adherence to the instructions
of the Event coordinator/instructors, in a safe and responsible manner, in
compliance with all applicable road traffic laws including the Motor Vehicles
Act 1988 and the Central Motor Vehicle Rules 1989, shall wear a helmet at all
times while on track (Guests may bring their own suitable helmet, subject to the
Organisers' approval), and shall fasten seatbelts at all times while on track.

The Guest is solely responsible for any damage to the Guest's Vehicle, and accepts
financial responsibility, subject to the liability cap set out in the Damage
Liability clause below, for any damage caused by the Guest's Vehicle to Event
property, track infrastructure, or the property of third parties, including
other participants.

The Organisers do not provide insurance cover for the Guest's Vehicle. Before
completing registration and payment, the Guest is strongly advised to check that
their own vehicle insurance is adequate for track/competition use, as standard
motor insurance policies may exclude such use; this is also disclosed at the
point of registration.
Organiser-Provided Vehicles
As part of the Event, the off-road course is run in a Volkswagen Tayron R-Line, and
Hot Laps are run in a Volkswagen Golf GTI, both made available to the Organisers by
Volkswagen India for demonstration purposes (each a "Provided Vehicle"). On the
off-road course, the Guest drives the Provided Vehicle themselves, guided by an
instructor positioned outside the vehicle. Hot Laps are driven by an
Organiser-appointed instructor, with the Guest riding as a passenger.
Volkswagen India retains title to the Provided Vehicles. No part of this document
shall be construed as a hire-purchase, rental or hire agreement, or any other
arrangement conferring a financial benefit to Volkswagen India or GTO from the
Guest's use of the Provided Vehicles.
Where the Guest drives a Provided Vehicle (the off-road course), the Guest shall
hold a full and valid driving licence recognised in India and shall produce the
original before driving commences; failure to do so will disqualify the Guest from
driving the Provided Vehicle, without exception. The Guest shall drive only in
adherence to the instructions of the Event coordinator/instructors, shall fasten
seatbelts at all times, shall not smoke in the Provided Vehicle, and shall ensure
that no active safety feature of the Provided Vehicle is disengaged.
Where an Organiser-appointed instructor drives a Provided Vehicle with the Guest as
a passenger (Hot Laps), no driving licence is required of the Guest for that activity;
the Guest shall fasten their seatbelt at all times and follow the instructor's
safety instructions.
The Guest shall be liable for loss or damage to a Provided Vehicle caused by the
Guest's own wilful misuse while driving it, and for any loss, damage or liability
not covered by insurance (such as tyre damage, insurance excess and other deductibles),
subject to the liability cap set out in the Damage Liability clause below. The Guest
shall not be liable for loss or damage arising while a Provided Vehicle is driven by
an Organiser-appointed instructor.
In the event of a breakdown of a Provided Vehicle during the Event that cannot be
repaired, the Organisers will make reasonable efforts to enable the Guest to continue
in the Event, but are under no obligation to arrange an alternate vehicle, and no
refund will be due for the affected activity.
Damage Liability
The Organisers maintain event insurance covering public liability and organiser
liability for the Event. Separately, and without affecting that cover, the following
liability applies to Guests in respect of vehicle and property damage, in each case
subject to a cap of INR 5,00,000 per incident, other than in respect of death or
personal injury arising from the Organisers' proven negligence, gross negligence
or wilful misconduct:

Damage to the Guest's own vehicle:
the Guest is solely responsible; the Organisers carry no insurance on the
Guest's vehicle.

Damage to a Provided Vehicle caused by the Guest's own wilful misuse
while driving it:
the Guest is liable, subject to the cap above. This applies to the off-road
course only, since Hot Laps are instructor-driven. The Organisers do not carry
a separate insurance policy on the Provided Vehicles beyond this cap.

Damage to another participant's vehicle caused by the Guest:
the Guest is liable to that participant directly, subject to the cap above;
the Organisers are not a party to, and do not adjudicate, claims between Guests.

Damage to Event or track property or infrastructure caused by the Guest:
the Guest is liable, subject to the cap above, as determined by the Organisers
and/or the track operator.

Injury or property damage to a third party caused by the Guest:
covered in the first instance by the Organisers' public liability insurance
referred to above; the Guest remains liable to indemnify the Organisers for loss
arising from the Guest's own negligence or wilful misconduct, as set out in the
Indemnity clause below.
Non-Transferable Policy
Seats issued or bought for the Event are non-transferable and must be used by the
first-intended recipient. Registrations cannot be moved to alternate dates or
rescheduled.
Non-Driving Guest Policy
Registered non-driving guests of any age are welcome to join for the hospitality and,
where applicable, classroom sessions and the Awards Ceremony. Non-driving guests will
not be permitted in vehicles or at drive modules for safety reasons, and must remain
within the hospitality area.
The cost for one non-driving guest is included in the Guest's registration. From the
second non-driving guest onwards (including accompanying minors), guests will be
charged at INR 1,000 per day. Non-driving guest capacity is limited and may not be
available at all sessions.
Every non-driving guest (or, for a minor, their parent or guardian) must sign the
Organisers' waiver/consent form on arrival, covering venue safety, conduct and
photography/data consent — see the Children clause below where the guest is a minor.
Travel and Accommodation
You are responsible for making your own travel and accommodation arrangements for
the Event, as these are not included in the Event cost.
Conduct and Instructor Authority
The Event coordinator and driving instructors are fully authorised to issue
directives, and all instructions must be strictly followed so that neither the Guest
nor other persons are harmed, and no property is damaged, as a result of the Guest's
conduct. Any deviation from the Event coordinator's instructions may expose the Guest
and others to potential danger, and a disobedient Guest shall be held responsible for
any loss, injury or damage caused to other Guests. Breaches may lead to expulsion
from the Event, without refund.
Guests shall follow a strict no-alcohol policy while at the Event and shall not drive
under the influence of alcohol (zero alcohol level), drugs or any other substance
impairing fitness to drive. Where a Guest is found in violation of this policy, the
Event coordinator has the authority to take any action deemed necessary in the
interest of the safety of the group, including withdrawal of the Guest from the
Event without refund.
Guests shall follow the Event itinerary. There shall be no refund if a Guest fails
to join at the appointed time, joins late, or leaves before the Event concludes.
It is the Guest's responsibility to reach the venue and register with the Organisers'
representative at the appointed place, date and time.
The Organisers reserve the right to withdraw the participation of any Guest whose
behaviour is deemed likely to affect the smooth operation of the Event or adversely
affect the enjoyment or safety of other Guests, and the Organisers shall be under no
liability to any Guest so expelled.
Guests are solely responsible for their own valuables, belongings and possessions
carried during the Event.
Health & Safety
The Event is a driving event that can place considerable physical and mental demands
on participants. Heat, dust, humidity and track conditions may affect Guests and their
equipment. The Event is suitable only for fully fit, healthy adults, and each Guest
should only undertake what they feel capable of doing.
It is the duty of the Guest to inform the Organisers of any medical condition
(including diabetes, hypertension or heart disease), relevant medical history, or
prescribed restrictions/allergies that may affect their ability to safely participate
in the Event.
The Organisers maintain on-site medical support for the Event, including first-aid
provision and, where arranged for the Event, a paramedic and ambulance. Where a Guest
requires medical attention, the Organisers will provide first-line assistance and
facilitate transport to the nearest appropriate medical facility if required; the
cost of such transportation will be borne by the Guest.
Guests should carry any personal medication they may need. The Event cost does not
include medical or accident insurance, and Guests are advised to arrange their own
personal accident/medical insurance at their own cost. The Organisers are not liable
for the adequacy of medical treatment received, or for any injury, disability, death
or sickness a Guest may suffer beyond providing the first-line assistance described
above, and no refund shall be due on account of any medical event.
Liability
The Organisers shall not be liable for any damage caused to the Guest due to
circumstances beyond the Organisers' control (force majeure). The Organisers shall
not be responsible for the loss of, or damage to, baggage or personal effects however
caused.
The Organisers shall not be responsible for any death, personal injury, sickness,
accident, loss, delay, discomfort, increased expenses, or any direct, indirect,
special or consequential loss or damage howsoever caused, and the Guest hereby forever
discharges the Organisers from all actions, causes of action, suits, debts, obligations,
claims and demands whatsoever which the Guest has, or hereafter can, shall or may have,
save in respect of death or personal injury arising from the Organisers' proven
negligence, gross negligence or wilful misconduct.
Indemnity
The Guest agrees to hold the Organisers harmless and indemnified against any loss,
damage, claim, suit, compensation, attorney expense, criminal prosecution or order
of court arising out of any injury, damage or loss to life or property of the Guest
or any third party, to the extent due to the Guest's own negligence, default,
omission or wilful act during the Event.
This indemnity does not extend to loss arising from the Organisers' own negligence,
gross negligence or wilful misconduct, and shall be binding on the heirs, executors
and legal representatives of the Guest.
Competition Rules
The Timed Autocross competition is run under the following rules:

Participants compete in categories determined by the Organisers based on vehicle
model and/or modification status.

Timing is by the Organisers' official timing system, whose recorded time is final.

A Guest may be disqualified from a category for unsafe driving, exceeding track
limits, or breach of the Event coordinator's instructions, without refund.
-
Vehicle eligibility for each category is determined by the scrutineering check
described above.
-
In the event of a tie, the Event's chief instructor/race director shall determine
the result at their discretion.
-
The chief instructor/race director's decision on all matters relating to the
competition is final.
Children
Guests under 18 years of age are permitted on-site as non-driving guests, subject to
a parent or guardian being present and accompanying them at all times. That parent
or guardian agrees to be responsible for the child throughout the Event, to ensure
the child remains within the hospitality area and away from vehicles and drive modules,
to sign the Organisers' waiver/consent form on the child's behalf, and to comply with
the obligations set out in these Terms and Conditions on the child's behalf.
Children must not be left unattended at any time.
Refunds & Cancellation Summary
Charges paid will be refunded in full if the Guest's registration is rejected by the
Organisers, or if the Event is cancelled by the Organisers. Charges will NOT be
refunded for any other reason, except as set out in the Refund Policy above.
Law & Jurisdiction
For any claims, suits, complaints or disputes relating to the Event and the services
provided by the Organisers, the courts and tribunals of Pune, India alone shall have
exclusive jurisdiction.
Personal Data and Photography Consent
The Guest's registration details (and, where applicable, those of any non-driving
guest) are collected and processed by GTO for the purpose of organising and operating
the Event, including registration, safety, and coordination with Volkswagen India.
This data will be shared between GTO and Volkswagen India to the extent necessary for
these purposes, retained for as long as reasonably necessary for the Event and
applicable legal requirements, and thereafter deleted or anonymised.
By participating in the Event, the Guest agrees that the Organisers and/or Volkswagen
India may capture and use the Guest's name, photograph, video or audio for event
documentation and operational purposes (such as safety records and event reporting),
without any compensation payable.
Separately, at the time of registration, the Guest (and, where applicable, any
non-driving guest) will be asked to indicate, through a dedicated consent checkbox,
whether they agree to their name, photograph, video, audio and contact details being
used for marketing and promotional purposes by the Organisers and/or Volkswagen India,
and to receive marketing communications.
This consent is optional, separate from the operational use described above, and may
be withdrawn at any time by writing to the Organisers.
Grievance and Escalation
For any queries before the Event, or any grievance or complaint arising during or
after the Event, Guests may contact the Organisers at
concierge@gtoevents.in.
The Organisers will endeavour to acknowledge and address all such queries and
grievances as promptly as reasonably possible.
